Conditions of Sales

The following terms and conditions and any other related rules that are adopted by L'École Van Cleef & Arpels made available as provided herein (collectively the “Conditions of Sale”) shall apply to all sales of L'ECOLE Van Cleef & Arpels' sessions, conversations and other training services (“Services”) that you (the “Client” or “you”) may order from L'École Van Cleef & Arpels, organized and existing under the laws of France and whose registered offices are located at 22 Place Vendôme, 75001 Paris, France (“L'ECOLE Van Cleef & Arpels” or referred to herein as “us”, “our” or “we”) either (a) by phone via the Point of Contact of L'ECOLE Van Cleef & Arpels (the “Point of Contact”) whose telephone number and email address are indicated on the Website or (b) on the Internet via L'ECOLE Van Cleef & Arpels' Website, identified by the domain name www.lecolevancleefarpels.com/us/en the "Website").

These Conditions of Sale apply only to sales made through the Contact Center or the Platform by individuals who are citizens of, or residents living in, the continental United States of America, Alaska, Hawaii or the District of Columbia at the time of placing the order. L'ECOLE Van Cleef & Arpels may modify the Conditions of Sale from time to time, at its sole discretion, and your continued use and/or registration following such change will signify your agreement to be bound by the modified Conditions of Sale.

The Conditions of Sale applicable to any order placed through the Contact Center or the Platform are those in force at the time that an order has been placed on your behalf by a L'ECOLE Van Cleef & Arpels Ambassador (in the case of an order placed through the Contact Center) or at the time you place your order (in the case of an order placed through the Platform). In the case of an order placed through the Platform, when you check the “I have read and I accept the Conditions of Sale" box at the payment section of the Platform before placing your order with L'ECOLE Van Cleef & Arpels, you indicate your acceptance of these Conditions of Sale. If you refuse to accept these Conditions of Sale, you will not be able to order any L'ECOLE Van Cleef & Arpels Services from the Platform or the Contact Center.

If you do not agree to any change to the Conditions of Sale, then you must immediately contact the Contact Center to cancel your registration and refrain from ordering any L'ECOLE Van Cleef & Arpels Services through the Contact Center or the Platform.

Persons wishing to use the Contact Center or the Platform will also be deemed, by virtue of such use, to have agreed to be bound by our Platform Terms of Use and our Privacy Policy, which are incorporated into these Conditions of Sale by reference. Customers using the Contact Center will be provided with access to our Privacy Policy as set forth in "Acknowledgment of Order" below.

Only individuals (and not legal entities) who (a) have reached the age of majority (eighteen in most states), (b) have legal capacity to enter into contracts and (c) are citizens of or residents living in the continental United States of America, Alaska, Hawaii or the District of Columbia may order Services through the Contact Center or on the Platform. If you are under the age of majority or otherwise cannot lawfully enter into a contract, you must have your parent or guardian place an order on your behalf and thereby assent to these Conditions of Sale. Any orders placed in violation of this provision shall be null and void.

By placing an order through the Contact Center or on the Platform, you represent and warrant that you are a bona fide end-user Customer and will not deliver, sell or otherwise market L'ECOLE Van Cleef & Arpels Services or purchase L'ECOLE Van Cleef & Arpels Services for commercial purposes or any other commercial benefit. All orders placed through the Contact Center or on the Platform are subject to availability and acceptance by L'ECOLE Van Cleef & Arpels. L'ECOLE Van Cleef & Arpels reserves the right to refuse at any moment in time, without prior notice, orders exceeding a certain number of authorized Services or for any other legitimate reason.

All orders placed through the Contact Center or on the Platform are subject to availability and acceptance by L'ECOLE Van Cleef & Arpels.

L'ECOLE Van Cleef & Arpels reserves the right to change the assortment of Services offered on the Platform or through the Contact Center, and may limit from time to time the quantity of L'ECOLE Van Cleef & Arpels Services that may be ordered by a Customer in a single buying session, without prior notice.

The Contact Center and the service pages on the Platform can provide you with information regarding Services that are currently available for sale through those channels. Please note that only those Services displaying an “Add to Shopping Bag" icon are available for sale through the Platform. You may also call the Contact Center (telephone number indicated on the Platform) and an Ambassador will provide you with further information as to Service availability and assist you with your purchase.

In order to place an order through the Contact Center or on the Platform, you or the L'ECOLE Van Cleef & Arpels Ambassador (on your behalf) may either register and create an online account on the Platform, or place an order as a guest without creating an online account by selecting the "Guest Checkout" option. In order to create this account, you will be required to provide valid and up-to-date personal information, such as your legal name, phone number and e-mail address, and to confirm that you have reached the age of majority. If you select the "Guest Checkout" option, you will have the option to create your L'ECOLE Van Cleef & Arpels online account upon receiving the Order Confirmation. Please note that in such case, your L'ECOLE Van Cleef & Arpels online account will not include transactions made prior to the creation of your account.

Upon completion of your account registration on the Platform or by the L'ECOLE Van Cleef & Arpels Ambassador, you will receive by email a one-time password, which will allow you to log in to your account on the Platform and create a permanent account login and password. You will also receive a second email summarizing the personal information you provided in registering for your online account. You are responsible for ensuring that your password and account login are kept secret, safe and secure at all times. L'ECOLE Van Cleef & Arpels will not be held responsible or liable for any misuse of your account in connection with, and/or resulting from, a third party's access to and use of your password and account login. Please refer to our Privacy Policy and Section 8 of these Conditions of Sale for more details about how we may use your personal information.

We may change the information required to place an order or the registration requirements from time to time. Any changes will be posted on the Platform. If you select the "Guest Checkout" option on the Platform, your online account will not be created and we will not use your personal information for any purpose other than in connection with processing your order. Please refer to our Privacy Policy for more details about how we may use your personal information.

If you are ordering on the Platform, orders will be processed as follows: Once you have chosen a Service, click on the “Add to Shopping Bag" icon to place this Service in your shopping bag. You may then decide to continue shopping for other Services and add them to your shopping bag (subject to availability and quantity limits) or proceed to “Checkout” by clicking on this button. You may also remove one or several Services you have selected by clicking on "X" next to the chosen Service in the Shopping Bag.

Once on the payment page, review your order details and personal information (including email, billing address and payment information), check the box next to "I have read and I accept the Conditions of Sale". Then, click on "Pay Now" to place your order.

When ordering by telephone through the Contact Center (telephone number indicated on the Platform), a L'ECOLE Van Cleef & Arpels Ambassador will follow the offer and order process on your behalf.

When ordering through the Contact Center or on the Platform, you will be required to provide personal information as applicable, such as billing address and payment details. Additional information may be collected by L'ECOLE Van Cleef & Arpels or its third party providers at this time for security and anti-fraud purposes. You represent and warrant that the personal information you provide to the Contact Center or via the Platform is true, valid, complete and up-to-date in all respects. Please refer to our Privacy Policy for more details about how and how long we may use or keep your personal information.

Notwithstanding anything to the contrary provided for herein, L'ECOLE Van Cleef & Arpels reserves the right to refuse, cancel and terminate orders at any moment in time. For example, L'ECOLE Van Cleef & Arpels may refuse, terminate or cancel your order if there is an ongoing dispute concerning payment of a prior order or if L'ECOLE Van Cleef & Arpels suspects, in its sole discretion, that you have engaged in fraudulent activities or have otherwise violated these Conditions of Sale.

As a foundation committed to supporting educational and charitable causes, L'ECOLE Van Cleef & Arpels does not offer refunds for payments made for any of the Services purchased by you.

Upon payment, the Service must be utilized within three (3) months from the date of the Service booking, this includes any further rescheduling made by you. If you wish to reschedule the Service booking, forty-eight (48) hours' notice must be provided to us stating your intention to reschedule the Service; for the avoidance of doubt this must also be within the three (3) month period of the initial Service booking. Failure to provide adequate notice as prescribed in this section will mean that the Service will be considered as utilized and automatically expired. The Services will be performed on the date mentioned on the Platform or by the Contact Center when you placed your order, and at 22 Place Vendôme, 75001 Paris, France.

All prices for the Services shown on the Platform or quoted by the Contact Center are in U.S. Dollars.

L'ECOLE Van Cleef & Arpels reserves the right to modify prices at any time without prior notice. However, the price of a Service displayed on the Platform or quoted by the Contact Center, as indicated at the time L'ECOLE Van Cleef & Arpels provides you with a Confirmation of Order, will be honored by L'ECOLE Van Cleef & Arpels.

The actual sales tax associated with your purchase will be calculated at the time when your order is confirmed, at which point you will receive a Confirmation of Order (as defined in Section 10). Please note that changes to applicable law between the date your order is placed and the date you are sent a Confirmation of Order may result in changes to the sales tax associated with your purchase. If the resulting change is an increase in the sales tax you are charged, we will contact you and ask that you reconfirm your purchase.

You should carefully check and confirm all details before placing your order through the Contact Center or on the Platform, including without limitation the particulars of each order, which will be provided by the L'ECOLE Van Cleef & Arpels Ambassador (in the case of an order being placed through the Contact Center) or displayed on the Platform (in the case of an order being placed through the Platform).

When you have completely reviewed your order, first check the box next to “I have read and I accept the Conditions of Sale” to indicate your agreement to be bound by these Conditions of Sale and then, click on the "Pay Now" button on the Platform to place your order.

By placing an order, you are submitting an offer to L'ECOLE Van Cleef & Arpels to purchase the Services you have placed in your “Shopping Bag”. Notwithstanding anything to the contrary provided for herein, L'ECOLE Van Cleef & Arpels reserves the right to refuse, cancel and terminate orders at any moment in time. For example, L'ECOLE Van Cleef & Arpels may refuse, terminate or cancel your order if there is an ongoing dispute concerning payment of a prior order or if L'ECOLE Van Cleef & Arpels suspects, in its sole discretion, that you have violated these Conditions of Sale.

8.1. Payment by credit or debit card

L'ECOLE Van Cleef & Arpels accepts the following credit cards: Visa, MasterCard, American Express, and Discover. You may also pay by using PayPal, as indicated on the Platform.

Your billing address must be in one of the countries indicated in Section 2 above. Cards with a billing address outside the continental United States of America, Alaska, Hawaii or the District of Columbia will not be accepted.

When ordering on the Platform, you will need to enter your payment details on the appropriate form. In the case of an order placed by telephone, you will need to communicate to the Contact Center your credit or debit card number and your three- or four-digit security code that is printed on the back or the front of your card (CVV2/CVC2/CID). Your telephone conversation will be recorded for security and quality control purposes. Any telephone conversation recorded by our Contact Center that contains your credit card information will be fully encrypted and only used to process card transactions. Please refer to our Privacy Policy for more details about how and how long we may use or keep your personal information.

All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to L'ECOLE Van Cleef & Arpels, you will need to contact your card issuer directly to solve this problem, and L'ECOLE Van Cleef & Arpels will not be liable for any delay or non-delivery.

In order to process your order, we may perform security checks on your credit card. The full amount of your purchase will be blocked on your credit card until your order is approved by L'ECOLE Van Cleef & Arpels, and your credit card will be charged the applicable purchase price once your order has been confirmed. By submitting an offer to purchase L'ECOLE Van Cleef & Arpels Services on the Platform or through the Contact Center, you expressly authorize L'ECOLE Van Cleef & Arpels to perform such security checks, where L'ECOLE Van Cleef & Arpels deems necessary, to transmit or to obtain information (including any updated information) about you to or from third parties from time to time, including but not limited to your credit card number, to authenticate your identity, to validate your credit card, to obtain a credit card authorization and to authorize individual purchase transactions. Please refer to our Privacy Policy for more details about how and how long we may use or keep your personal information.

8.2. Security

L'ECOLE Van Cleef & Arpels takes precautions — including administrative, technical, and physical measures — to safeguard your personal information against loss, theft, and misuse, as well as against unauthorized access, disclosure, alteration, and destruction. L'ECOLE Van Cleef & Arpels uses Secure Sockets Layer (SSL) encryption on all web pages where personal information is collected.

Unfortunately, transmitting information over the Internet is not completely secure. Although we will implement appropriate measures to protect your personal information, we cannot guarantee the security of the data you transmit; any transmission is at your own risk and we cannot be held liable. For more information about how we use and protect your information please view our Privacy Policy.

L'ECOLE Van Cleef & Arpels is prohibited under U.S. law from making sales of its services to individuals or companies designated on the Office of Foreign Assets Controls ("OFAC") Specially Designated Nationals ("SDN") List, or to country destinations sanctioned by the U.S. Any such transactions will be declined.

We only accept bank wire transfer for orders placed through the Contact Center. We do not charge a fee for bank wire transfers for orders made through the Platform or Contact Center; however, some financial institutions may charge a fee for using a bank wire transfer. We require that all bank wire transfer orders placed by telephone be confirmed through an order approval process. We may acknowledge a bank wire transfer order, but the order will not be processed until the payment has been received and confirmed by us by email. If your wire transfer payment is not credited into our bank account within fourteen (14) days after you have placed your order, your order will be cancelled.

Once you have placed your order through the Contact Center or on the Platform, you will receive an Acknowledgment of Order by email acknowledging the details of your order. This Acknowledgment of Order will contain an Order Reference Number assigned by L'ECOLE Van Cleef & Arpels. Please make sure that you save this Order Reference Number for any future enquiries regarding your order. This Acknowledgment of Order is not an acceptance of your order. Following the transmission of the Acknowledgment of Order, L'ECOLE Van Cleef & Arpels will conduct its usual credit, anti-fraud, security and related legal checks and, if acceptable, will then process your order. These Conditions of Sale will be provided to you with the Acknowledgment of Order through either email link or pdf. Please carefully review these Conditions of Sale upon receipt.

When ordering by telephone through the Contact Center, you will also receive by email these Conditions of Sale along with the Acknowledgment of Order. Please carefully review these Conditions of Sale upon receipt.

Upon confirmation of your order, following completion by L'ECOLE Van Cleef & Arpels of its anti-fraud, security and related legal checks, L'ECOLE Van Cleef & Arpels will send you by email a written Confirmation of Order.

The Confirmation of Order constitutes the acceptance of your order by L'ECOLE Van Cleef & Arpels and indicates the existence of a binding contract.

The Acknowledgment of Order and Confirmation of Order that are sent to you by email are deemed to be received when you are able to access them on your computer, mobile or handheld device.

The Confirmation of Order and any automatic recording systems used by the Contact Center or the Platform will be proof of a binding agreement between you and L'ECOLE Van Cleef & Arpels.

When ordering Services on the Platform or through the Contact Center, you, as the Customer, will have the option to choose whether you wish to receive an invoice to your billing address. If you decide at this moment that you do not want to receive an invoice, you may request an invoice no longer than twelve (12) months after purchase confirmation by calling the Contact Center (telephone number indicated on the Platform) subject to providing proper identification to the Contact Center.

Please note that L'ECOLE Van Cleef & Arpels will not send the invoice and payment details to the gift recipient.

L'ECOLE Van Cleef & Arpels may exceptionally cancel sessions, conversations and other Services in case of force majeure or if circumstances beyond our reasonable control prevent the provision of Services.

If that is the case, we will contact you immediately and postpone the Services to a later date. If postponing is not possible, we will reimburse to you all payments received from you, without undue delay and in any event not later than fourteen (14) days from the day on which we informed you about the cancellation, but no other form of compensation will be due by L'ECOLE Van Cleef & Arpels. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, without charging you any fee.

We draw your attention on the specific conditions applicable to the Services given by L’ECOLE Van Cleef & Arpels in the form of the special course menu offer.

In the event you start following one or several sessions subject to the special course menu, and that you no longer wish to attend the remaining session(s) of the special course menu offer that you did not attend yet, the total price of the special course menu will be due on your end, and the whole sessions included in this special course menu offer shall therefore be non-refundable.

The registration to the sessions which are subject to the special course menu offer is nominative and non-transferable to a third party. By registering to our Services subject to the special course menu offer, you therefore accept that only one person may attend the sessions subject to this offer. 

You also accept, by registering to the Services which are subject to the special course menu offer, that those sessions may not be substituted by another session or other Services offered by L’ECOLE Van Cleef & Arpels: the sessions which are subject to the special course menu are therefore non-modifiable.

We draw your attention to the specific conditions applicable to the Services given by L’ECOLE Van Cleef & Arpels in the form of the “Workshops for Young People”.

By certifying that you have read and accepted the conditions of your child’s registration to any of the “Workshops for Young People”, you authorize your child to travel to, and participate in, the Creative Workshops organized by L’ECOLE Van Cleef & Arpels. You authorize your child to travel to L’ECOLE and leave the premises following the end of the Workshop, unaccompanied. You therefore exempt L’ECOLE of all responsibility to the fullest extent permitted by applicable law. For the duration of the Creative Workshops, where the presence of a parent or accompanying adult is required (5-8 years), the child remains under the responsibility and supervision of said parent or accompanying adult. You hereby certify that your child is covered by an up-to-date liability insurance policy, details of which you can provide upon simple request.

You may have mandatory legal rights under applicable federal and state consumer protection laws; those legal rights are not affected by these Conditions of Sale. Nothing in these Conditions of Sale limits or excludes our liability for any liability which cannot be limited or excluded by applicable law.

While L'ECOLE Van Cleef & Arpels endeavors to verify the accuracy of any information it places on the Platform, in advertisements or catalogues or by the Contact Center, it makes no guarantees, whether express or implied, in relation to the accuracy, reliability and completeness of such information. To the fullest extent permitted by applicable law, we disclaim and exclude all other terms, conditions and warranties in relation to the Services and any orders placed through the Platform or Contact Center, whether express or implied by statute or otherwise or arising from any previous course of dealing or usage or trade practice. L'ECOLE Van Cleef & Arpels does not confirm the price of a L'ECOLE Van Cleef & Arpels Service until a Confirmation of Order has been issued by L'ECOLE Van Cleef & Arpels, indicating the existence of a binding sales contract. If a L'ECOLE Van Cleef & Arpels Service's current price is different than the price posted on our Platform, then L'ECOLE Van Cleef & Arpels will either contact the Customer for instructions or, if L'ECOLE Van Cleef & Arpels cannot obtain your instructions, reject the order and notify you of such rejection.

While every effort will be made to ensure that the descriptions, photographs or graphical representations relating to the L'ECOLE Van Cleef & Arpels Services detailed on the Platform or in a catalogue are as accurate as possible, L'ECOLE Van Cleef & Arpels does not warrant that such materials or other content are error-free, whether as a result of inaccuracy, omission, obsolescence or otherwise.

Subject to the preceding provisions regarding non-excludable liability, our aggregate liability to you under these Conditions of Sale for any order whether in contract, tort (including negligence) or otherwise, even if we have been advised of the possibility of such damages shall in no event exceed one hundred percent (100%) of the price of the Service(s) in your order. Please note that in some jurisdictions, consumer protection laws do not allow certain exclusions or limitation of warranties or liabilities, and consequently some of the above exclusions and limitations do not apply.

For further information or complaints, you may also contact the Contact Center on the telephone number and email address indicated on the Platform.

Entire Agreement. These Conditions of Sale (and associated terms incorporated by reference) constitute the entire agreement between you and us in relation to the order of Services, and replace and extinguish all prior agreements, draft agreements, arrangements, undertakings, or collateral contracts of any nature made by the parties, whether oral or written, in relation to such subject matter.

Force majeure. We are not responsible for any failure or delay in performing or complying with our obligations under these Conditions of Sale which arises from any cause beyond our reasonable control.

Severability. If any provision, or part of a provision, of these Conditions of Sale is deemed to be illegal, invalid or unenforceable, the remainder of the provisions of these Conditions of Sale shall be unaffected and shall continue to be fully valid, binding and enforceable.

Waiver. The waiver by us of a breach of any provision of these Conditions of Sale will not operate to be interpreted as a waiver of any other or subsequent breach.

Third Party Rights. This contract is between us and you. No other person shall have any rights to enforce any of its terms.

These Conditions of Sale shall be governed by and construed in accordance with the Federal Arbitration Act and, where applicable, the laws of the State of New York, without reference to conflict of laws provisions. Any dispute, controversy or claim arising out of or related to the Conditions of Sale, including the validity, invalidity, breach or termination of the Conditions of Sale, or to any Services purchased from L'ECOLE Van Cleef & Arpels through the Platform or Contact Center, will be resolved by binding arbitration, rather than in court, except that a consumer or L'ECOLE Van Cleef & Arpels may assert claims in small claims court if such claims qualify.

You understand and agree that you are waiving your right to sue or go to court to defend your rights, including to a trial by jury, under these Conditions of Sale. In addition, you and L'ECOLE Van Cleef & Arpels understand and agree that the parties will pursue any dispute on an individual basis. The arbitrator is empowered to resolve the dispute with the same remedies available in court, however, any relief must be individualized to you and shall not affect any other consumer. You and L'ECOLE Van Cleef & Arpels agree that each may not bring a claim against the other as part of any class action, class arbitration, or other representative proceeding.

The arbitration will be conducted in the state and county where you reside (as determined by your address on file with L'ECOLE Van Cleef & Arpels) or at consumer's election, Paris, France, by the American Arbitration Association ("AAA") under its rules, including the AAA's Supplementary Procedures for Consumer-Related Disputes. The AAA's rules are available at www.adr.org or by calling 1-800-778-7879. Payment of all filing, administration and arbitrator fees will be governed by the AAA's rules. Before bringing any dispute in arbitration, you and L'ECOLE Van Cleef & Arpels agree that you will first notify the other party and make reasonable efforts for a period of thirty (30) days to resolve amicably any dispute or failure to agree that may arise out of or relate to the Services, the Conditions of Sale or any potential or alleged breach thereof. This requirement is a pre-condition, and no claim shall be filed in arbitration (or small claims court) until this provision is first met.
